REQUIRED "BOILERPLATE" CONTRACT LANGUAGE GUIDANCE
FOR PROJECTS USING WYOMING SRF FUNDS FROM
AMERICAN RECOVERY AND REINVESTMENT ACT OF 2009

You need to incorporate the various clauses and forms discussed below into all bid documents
and construction contracts for projects using the referenced funds. The required location for
these clauses and forms is based on an Engineers Joint Contract Documents Committee
(EJCDC) type contract. Please discuss with the SRF Program if you intend to use a different
type of contract or wish to place SRF required language in alternate locations. In addition to
the specific language in this SRF guidance document, you also need to take into account the
requirements in all applicable state statutes, including especially the following statutes dealing
directly with public works projects: W.S. 16-6-101 through -121 (for all public entities), 16-6-
701 through -708 (for all public entities), and 15-1-113 (for municipalities and joint powers
boards which include a municipality).
You need to send your documents to the SRF Program for approval prior to advertising for bids.

After you receive bids on the project you must get SRF approval before you award the contract.
Contact Wade Verplancke if it is a drinking water project or Brian Mark if it is a clean water
project.
We do not provide specific language to cover the following topics, but you must show us that
your documents cover and comply with the statutory or regulatory requirements:
- advertise for bids twice, one week apart, W.S. 15-1-113 (a) and (b)
- advertisement must begin
