Enforcement Procedures Antibiotics in Milk
Samples
Procedures to use in response to a positive growth inhibitor in a producer's milk
supply are as follows:
A. Complete and issue "Cease and Desist order" (Form 2124) to producer.
1. Complete yellow tag (Form 2138) and attach to outlet valve of farm bulk
milk tank. Tag is to be checked at items listed for (1) presence of
antibiotics and (2) unlawful for human consumption.
2. Notify tanker driver and/or pool agent of action taken. (This will usually be
done from the office)
3. Resample milk supply as soon as one complete milking or more is
available. If lab analysis on the resample is positive, the product must be
discharged to waste and another sample taken after the next complete
milking.
4. If lab analysis is negative, complete "Release from Cease and Desist
order" (Form 2125) and remove yellow tag from outlet valve of bulk tank.
Notify producer, tanker driver and/or pooling agent of action taken.
5. In most cases, the handlers are assessing a penalty to the producer which
meet the provisions of PMO appendix N. This requires a two-day
suspension or equivalent penalty for the first occurrence and four days for
the second in a twelve-month period.
B. Upon issuance of the release from Cease and Desist order, immediately
respond with a 48-hour or 4-milking suspension of Grade privilege.
1. Use regular premises suspension notice (Form 2043)
2. In case resample is negative, pre-date the suspension notice to include
the number of milkings already in the tank.
3. Release from suspension date must cover at least four (4) milkings or 48
hours.
4. Include time of day with effective date of suspension and release from
suspension.

5. Under sanitary items in violation, write in--OAR Chapter 603, Sections 24-
605 (Health of cows) and 24-594 (antibiotics); product contained
antibiotics.
