PREAMBLE
This agreement entered into between the School District of Fall Creek, Eau Claire County, hereinafter
referred to as the Board, and the Fall Creek Education Association, hereinafter referred to as the
Association.
The general intent of this agreement is to further the purpose of the parties in providing maximum
education opportunities for the District.
ARTICLE I - RECOGNITION
The Board recognizes the Fall Creek Education Association as the sole and exclusive bargaining
representative on wages, hours, and conditions of employment for all certified full-time and regular-part
time classroom teachers under direct contract to the Board of The School District of Fall Creek, including
guidance counselors, librarians, and traveling teachers, but excluding the following:
1.
Administrators and Coordinators who spend more than 50% of their time performing the function
of said position;
2.
Supervisors, principals and department heads who spend more than 50% of their time in
supervision and evaluation;
3.
Specialists hired through CESA if not under direct contract to the Board;
4.
Substitute teachers, para-professionals, teacher aides, non-certified employees.
ARTICLE II - MANAGEMENT RIGHTS
The Board of Education, in its own behalf, hereby retains and reserves unto itself, without limitations, all
powers, rights, authority, duties and responsibilities conferred upon and vested in it by applicable law,
rules, and regulations to establish the framework of school policies and projects including, but without
limitation because of enumeration, the right:
1.
To the executive management and administrative control of the school system and its properties
and facilities, and the activities of its employees while on duty;
2.
To employ and re-employ all personnel and, subject to the provisions of law or State Department
of Public Instruction regulations, determine their qualifications and the conditions of their continued
employment, their dismissal, demot
