On May 31, 2009 China announced draft Regulations on Supervision of Functional Foods. This
measure primarily regulates foods that have a functional or health claim associated with their
use. This measure was open for domestic comment until July 19, 2009. This measure was published
by the State Council Legislative Office (SCLO).
The following is the description of the measure as posted on the SCLO website: “In order to further
enhance the transparency of government legislative work to improve the quality of the draft
administrative regulations, the State Council Legislative Affairs Office decided that the Ministry of
Health submitted to the State Council for consideration of the "health food Supervision and
Management Regulations (draft)" and its description published the full text to solicit views of the
community in order to further study, the revised report to the State Council executive meeting. Hereby
notify the related matters are as follows:
