Empire Resorts Announces Settlement with
Former CEO

MONTICELLO, N.Y.--(EON: Enhanced Online News)--Empire Resorts, Inc., (NASDAQ: NYNY) today
announced the settlement of an action it had filed against its former CEO, Joseph Bernstein, in January 2010. The
parties reconciled their differences for the benefit of the Company and its shareholders.
The Company recognizes that Mr. Bernstein was responsible for negotiating a $55 million investment by Kien Huat
Realty III Ltd. to provide it with additional capital and is grateful to Mr. Bernstein for his success in those endeavors.
Joseph Bernstein added, “This is a great company, with a superb Board and management.”
