Defendant Google, Inc. (“Google”) moves to dismiss the First Amended Complaint
(“FAC”) of Plaintiff Kinderstart.com LLC (“Kinderstart”) pursuant to Rule 12(b)(1) and Rule
12(b)(6) of the Federal Rules of Civil Procedure. For the reasons set forth below, the motion will
be granted with leave to amend. Consideration of Google’s special motion to strike pursuant to
California Code of Civil Procedure § 425.16 will be deferred pending further amendment of
Kinderstart’s complaint.
