PERSONS GIVING UNDERTAKING
These undertakings are given to the Australian Competition and Consumer
Commission (<tthe Commission'') by Collection House Limited (ACN 010 230
716 ) (K<collection House'') and Lion Finance Pty Ltd (ACN 095 926 766)(d<Lion
Finance'') of 488 Queen Street, Brisbane, in the State of Oueensland, under
section 87B of the Trade Practices Act 1974 (ffthe Act'').
Collection House is a company duly incorporated and carrying on a debt
collection business in Australia.
Lion Finance is a company duly incorporated and carrying on a debt purchase
business (including the debt collection of purchased debts) in Australia.
4. In the course of their respective debt collection and debt purchase businesses,
both Collection House and Lion Finance have, from time to time, acquired debt
ledgers at a discount and subsequently engaged in collection activity in relation to
those purchased ledgers.
On or about 29 June 2000, Collection House entered into an agreement with
Australian Guarantee Corporation Limited ((<AGC'') pursuant to which
Collection House acquired 64,515 debts from AGC (ffsrst AGC tranche').
Collection House engaged in collection activity in relation to the first AGC
6. On or about 4 September 2001, Lion Finance entered into an agreement with
AGC in which Lion Finance acquired 55,963 debts from AGC Caseconv AGC
tranche''). Lion Finance engaged
in collection activity in relation to the
second AGC tranced.
On or about 20 November 2002, Collection House entered into an agreement
with Lion Finance in which Lion Finance purchased the first AGC tranced
from Collection House.
8. In the course of conducting collection activity in relation to the first AGC
tranced and the second AGC tranced respectively,
