CONTRACT FOR SALE AND PURCHASE
OF REAL ESTATE
THIS AGREEMENT, dated November XX, 2007, is entered into by and between Sam Seller, residing at 123
Any Street, Anytown, NY 14211 (SELLER) and _____________________________________________, residing at
__________________________________________________________________________ (PURCHASER).
1.
SELLER shall sell and PURCHASER shall purchase the Bond and Mortgage owned by SELLER for the
property commonly known as 111 Whatever Street, Anytown, New York, measuring 36.83 feet front by 56.5 feet deep
and having a tax map number of 105.67-2-2 (the PROPERTY). PURCHASER is not purchasing the PROPERTY, but
rather the Bond and Mortgage secured by the PROPERTY.
2.
PURCHASER shall pay to SELLER the sum of XXXXXXXXX dollars ($XX,000.00). A non-refundable
deposit of five hundred dollars ($500.00) shall be paid directly to SELLER within 48 hours of the PURCHASER’S
winning bid on eBay to bind this deal. The balance ($XX,000.00) shall be deposited with the SELLER's attorney within
five (5) business days of the PURCHASER'S winning bid. The balance shall be held by SELLER'S attorney, until the
time of ownership transfer (CLOSING).
3.
SELLER’s attorney shall prepare the necessary documents to transfer ownership from SELLER to
PURCHASER, and legally record said documents. PURCHASER will pay a fee of three hundred twenty-five dollars
($325.00) to cover the costs associated with transfer and recording. In the event PURCHASER elects to hire an attorney
of its own, any associates cost will be the sole responsibility of the PURCHASER.
4.
Closing shall occur within thirty (30) days from the date of this contract. In the event PURCHASER
delays the closing beyond this date, PURCHASER may be charged one hundred dollars per day for each day thereafter
until closing.
5.
This document contains the entire agreement between SELLER and PURCHASER. A facsimile or email
attachment may be considered valid as the original.
