California State Motor Vehicle Pollution Control Standards; Notice of Decision Granting a
Waiver of Clean Air Act Preemption for California’s 2009 and Subsequent Model Year
Greenhouse Gas Emission Standards for New Motor Vehicles
SUMMARY: The Environmental Protection Agency (EPA) is granting the California Air
Resources Board’s (CARB’s) request for a waiver of Clean Air Act preemption to enforce its
greenhouse gas emission standards for model year 2009 and later new motor vehicles. This
decision is under section 209(b) of the Clean Air Act (the “Act”), as amended. This decision
withdraws and replaces EPA’s prior denial of the CARB’s December 21, 2005 waiver request,
which was published in the Federal Register on March 6, 2008.
