A RESOLUTION introduced by Councilmember Clark Duffy, granting Washburn

University an exception to the provisions of City of Topeka
4
Code Section 54-148 concerning noise prohibitions.

WHEREAS, City of Topeka Code Section 54-148 makes it unlawful for
7
any person to make, continue or cause to made or continued any loud,
8
unnecessary or unusual noise or any noise which either annoys, disturbs, injures
9
or endangers the comfort, repose, health or safety or others within the limits of
10
the city; and
11
WHEREAS, City of Topeka Code Section 54-148 authorizes the City
12
Council to grant exceptions to the prohibitions of this code section upon request
13
and a showing that the proposed activity does not offend the spirit of the findings
14
of City of Topeka Code Section 54-146; and
15
WHEREAS, Washburn University has requested that it be granted an
16
exception to the provisions of City of Topeka Code Section 54-148 for the
17
purposes, dates and times described herein, and
18
WHEREAS, upon review of the application of Washburn University, the
19
Council of the City of Topeka does hereby find that the requested activity does
20
not offend the spirit of the findings of City of Topeka Code Section 54-146.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
22
Topeka that Washburn University is hereby granted an exception from the
23
provisions of City of Topeka Code Section 54-148 for amplified sound at the
24

National Talk Like a Pirate Day event located at 1700 SW College Avenue during
25
the hours of 11:00 a.m. and 1:30 p.m. on September 19, 2006.

The event will be held on the grounds just outside the east doors of the
27
Memorial Union.
