Most standard time charter party forms contain an indemnity. It may be an implied indemnity as contained in, for example, clause 8 of the Nype (46), or it may be an express
indemnity such as the one contained in clause 9 of the BALTIME 1939 or clause 30 of the NYPE 93.
A General Paramount Clause should not be incorporated into the BALTIME 1939. The owners are better protected by the printed text of clauses 9 and 12. Another approach can
be found in clauses 17 and 18 of GENTIME and clauses 18 and 19 of BOXTIME 2004 both of which are quite detailed, as opposed to the approach taken in clause 27 of NYPE 93
setting out that cargo claims are to be settled in accordance with the Inter-Club Agreement.
