TEMPORARY STAY O R D E R
Before: NORRIS, McKEAGUE, and WHITE, Circuit Judges.
Defendants are charged with seditious conspiracy, attempt to use weapons of mass
destruction, and possession of a firearm in relation to a crime of violence. In addition, two
defendants are charged with teaching and demonstrating the use of explosive materials. Following
hearings, magistrate judges ordered the detention of all defendants pending trial. The defendants
moved the district court for revocation of the detention orders.
Following an evidentiary hearing, the district court, on May 3, 2010, issued a 36-page order
granting defendants’ motions for revocation of the detention orders, imposing conditions of release
applicable to all defendants, and establishing additional requirements for third-party custodians of
the defendants. In a separate order, the district court temporarily stayed the revocation order pending
the government’s decision to appeal. The government appealed the revocation order and

supplemented its request for a stay before the district court. On May 5, the district court denied the
government’s motion to extend the stay.
The government now moves this court to stay the revocation order pending determination
of the merits of this appeal. On May 6, we issued an order temporarily staying the revocation order
and ordering defendants to file a response to the government’s motion for stay by 5:00 p.m. on May
