CODE OF PRACTICE FOR TENDERING

OBJECTIVE
The objectives of this Code of Practice are to provide guidelines for best practice in
tendering, to set out the Council’s expectations of Tenderers and to outline the steps that the
Council will follow when tendering for goods, services or works.
APPLICATION OF THE CODE OF PRACTICE
This Code of Practice applies to all tendering which the Council undertakes.
GENERAL PRINCIPLES
The principles outlined in this Code of Practice are consistent with other relevant national
codes and standards.
Council will:
•
conduct tendering honestly and fairly to all parties;
•
refrain from inviting tenders without a firm intention to proceed;
•
apply the same conditions of tendering for each Tenderer;
•
avoid any practice which provides one party an improper advantage over another; and
•
comply with all legislative obligations.
Council expects Tenderers to:
•
refrain from submitting tenders without a firm intention and capacity to proceed;
•
refrain from all improper practices including collusive tendering; and
•
comply with all legislative obligations.
TENDERING METHODS
•
Expressions of Interest
The Council may use an Expression of Interest process before it invites tenders and
based on the responses it receives, Council may then proceed to invite selected
tenders from some or all of the registrants or may determine not to invite selected
tenders from any of the registrants.

Selected Tender
Council may undertake a selected tender offer to a limited number of suppliers,
consultants or contractors with proven ability drawn from an expression of interest
process, or where it is known that there is a limited number who can provide the
required good or service, or in circumstances of urgency.

Council may issue an invitation to tender with no restriction o
