Districts, Divisions and Judges
The State of Florida consists of three Federal Court Districts: Northern District, Middle District and
Southern District. Procedures concerning post-petition payments, stay litigation and confirmation
procedures vary from district to district and even vary according to the division within the same federal
district. Procedures in the Middle District of Florida vary based on the division. Procedures in the
Northern and Southern Districts are consistent throughout those districts even though there are separate
divisions within those districts. The main divisions within the Middle District are: Jacksonville Division,
Orlando Division, Tampa Division.
The Tampa office of Shapiro & Fishman is equipped to handle all Northern District and Middle District
Bankruptcy matters. The Aventura office of Shapiro & Fishman handles all Southern District cases.
Proofs of Claim – Chapter 13 Cases
When a new Chapter 13 bankruptcy is referred to our office, it is our policy to file a proof of claim unless
the client desires to file a claim on their own. In order to file the proof of claim, it is imperative that we
receive detailed financial information setting forth the amounts due and the arrearages on the mortgage
up to the date the bankruptcy case is filed. The proof of claim establishes the amount the lender will
receive for pre-petition arrearages from the trustee pursuant to a confirmed Chapter 13 plan.
Accordingly, it is vital that the figures be accurate.
Confirmation of Chapter 13 plans occurs typically after the bar date for the filing of proofs of claim. It
should be noted that in the Southern District of Florida, confirmation of a Chapter 13 plan is considered
the same day as the debtor’s Section 341 Creditor’s Meeting. Accordingly, it extremely helpful to file a
claim before this confirmation hearing occurs even though the bar date for filing the proof of claim may
