The goal is to provide immigration legal services to poor and low-income immigrants who are seeking assistance in preparing their cases for review by the Bureau of Citizenship and Immigration services (BCIS). The major focus is to assist in Family Reunification and Naturalization for the elderly, disabled, and poor. Catholic Charities of Idaho’s Boise and Nampa offices are recognized by the Board of Immigration Appeals (BIA) under the U.S. Department of Justice. The immigration program is affiliated with the Catholic Legal Immigration Network, Inc. (CLINIC) which presently is the largest network of non-profit immigration law offices in the United States of America. Catholic Charities of Idaho has access to a toll-free hotline to receive help from CLINIC’s immigration attorneys directly. Services Offered: Services provided by Co-Ad include information and referral; negotiation or mediation; investigation of suspected abuse or neglect; legal representation for violations of disability related rights; and technical assistance. Co-Ad staff also address system and policy issues. Services are provided statewide at no cost to the client. Eligibility Criteria: The person seeking assistance from Co-Ad must have a physical or mental disability and be requesting assistance with a disability-related issue. Programs: Co-Ad is the state’s designated Protection and Advocacy System and receives seven different federal grants that mandate legal and advocacy services to individuals with disabilities. Each program sets annual priorities and has various amounts of funds available. The priorities and amount of resources for each grant determine the extent of Co-Ad’s assistance. Domestic Violence/Sexual Assault Clinic: Representation of victims of domestic violence, sexual assault, dating violence or stalking in civil litigation in state or federal courts in North-central (2nd Judicial District) Idaho and represents victims of such crime in civil cases such as divorce, child custody, etc. Appellate Clinic: Representation of low income or pro se litigants referred by the appellate courts, other attorneys or from the General Clinic in Idaho and the Ninth Circuit. Tribal Clinic and Immigration Clinic: Defending adult tribal members in criminal matters in Nez Perce Tribal Court, Representing juvenile tribal members in delinquency cases, Representing immigrants in removal proceedings before Immigration Judges, the Board of Immigration Appeals, and Federal Courts, Advocating for immigrants in their applications for permanent residence, citizenship, and political asylum filed with the Department of Homeland Security. Tax Clinic: Representation of taxpayers from Idaho and surrounding states in controversies with the Internal Revenue Service. Also provide educational outreach services for taxpayers for whom English is a second language. Small Business Legal Clinic: The SBLC provides a variety of transaction related advice to business owners and entrepreneurs in Idaho, including the formation of an appropriate business entity, preparation and review of confidentiality and employment agreements, review of commercial leases, and, in the case of nonprofit organizations, the preparation and handling of applications for tax-exempt status. Eligibility criteria: For the general clinic, a client whose income is equal to or less than 125% of the Federal Poverty Income Guidelines is financially eligible for Clinic representation. Mediation services are available on a sliding fee basis for clients with incomes under 225% of the federal poverty guidelines. Eligibility for Victims’ Rights Clinic is not contingent upon income. For the tax clinic, a client whose income is equal to or less than 250% of the Federal Poverty Income guidelines are established by Health and Human services is eligible for representation. Non-profit groups, whether or not incorporated, will be eligible. Self-help materials for individuals processing routine case matters, predominantly in family law cases. Services Offered: Forms and instructions for some routine court matters: divorce, custody, modification, name change, landlord-tenant, minor guardianship. Referral to the toll-free Legal Resource Line (operated by the Idaho Law Foundation) and the Domestic Violence and Senior Hotlines (through Idaho Legal Aid Services). Instructional videos on the Idaho Courts, Family Law, Domestic Violence petitions for civil protection orders, and Small Claims. In addition to standard forms, instructions and videos, some offices provide: case screening and processing of applications for Idaho Legal Aid Services and Idaho Volunteer Lawyers Program; a list of local attorneys; referral to available social services including mediation; review of completed court forms; and will explain the basics of legal research. Some offices also have a computer or typewriter available for patron use to prepare court documents, and provide instructions in the use of the computer. Eligible case-types: Divorce, custody, modification, name change, landlord-tenant. Generally no one is turned away; however there may not be materials available for the patron’s specific case type. For example, we do not have materials for personal injury cases, administrative cases such as workers’ compensation or social security, federal cases such as bankruptcy, or transactional materials such as wills or contracts. We do not have forms or instructions for temporary orders, restraining orders, or motion and order to strike child support arrearages. We do not provide typing or other services to complete a form for a patron. We do not provide legal advice. Eligibility Criteria: None. To contact the Lawyer Referral Service, call (208) 334-4500 between 8:00 am to 4:00 pm (MST) Lawyer Referral Service Goal: The Lawyer Referral Service (LRS) is operated as a public service of the Idaho State Bar. All LRS attorneys are members in good standing with the Idaho State Bar with no pending public disciplinary complaints and the LRS attorneys carry Professional Liability Insurance. The LRS attorneys have agreed to provide their clients with an initial $35.00 half-hour office consultation fee. LRS attorneys handling Personal Injury or Workers' Compensations cases have agreed to a free consultation. After initial half-hour, any further fees are to be negotiated between the lawyer and client. The Idaho State Bar does not charge the public for these referrals and receives no money from the attorneys for the referrals. All attorneys listed in either the online or call-in LRS database have paid a fee to participate in the LRS. Not all Idaho State Bar attorneys are members of the LRS service. Client Requirements: We do require from the client a phone number, address, and information on the area of law, so we can determine what attorney to refer the client. These Acts protect consumers, businesses, and the marketplace from unfair or deceptive acts and practices. The Consumer Protection Unit seeks to fulfill this charge efficiently and economically through education, mediation, and enforcement. Specific services are provided: The Consumer Protection Unit functions in three areas to help protect individuals and businesses from deceptive practices: • CONSUMER EDUCATION: To accomplish these goals, the Consumer Protection Unit sponsors television and radio public service announcements, provides pamphlets on consumer topics, informs the media about current scams, and presents programs on consumer protection to community groups. In addition, the consumer protection staff provides consumer information and referral to citizens by telephone and in person. • MEDIATION OF COMPLAINTS: Mediation of complaints is another major service of the Consumer Protection Unit. Mediation relies on the voluntary cooperation of both sides of a complaint--usually a business and a consumer. The Consumer Protection Unit's Consumer Specialist acts as a "go between" or buffer for the parties who may have difficulty in communicating with one another directly. Because of the tremendous volume of complaints received by the Consumer Protection Unit, almost all of the mediation process is accomplished by correspondence. The consumer specialist forwards a consumer's written complaint to the business along with a letter requesting a response from the business. Private consumer complaints are often resolved as a result of the Consumer Protection Unit's mediation process. • LITIGATION AGAINST COMPANIES AND INDIVIDUALS: The Consumer Protection Unit files lawsuits on behalf of the State of Idaho as determined by the Attorney General on a case-by-case basis. The Attorney General's Office cannot provide legal advice or opinions to private individuals or businesses. Helpful tip sheets, brochures, and press releases are available to the public, but the only "client" the Consumer Protection Unit has is the State of Idaho. It is available to families who are employed, enrolled in school, looking for work, or are in job training. CHIP. - (Medicaid): If you cannot afford medical care or health insurance for you or your child, Children’s Health Insurance Program (CHIP) may be able to help. It is a health insurance program that can provide parents and children with comprehensive, quality health care. You do not have to be on cash assistance to receive Medicaid. Food Stamp Benefits: A federal program to help families with food expenses. Temporary Cash Assistance may be available to you and your family through the Temporary Assistance for Families In Idaho (TAFI) program. Telephone Service Assistance - The Telephone Assistance Program (ITSAP) can help with 50 percent or installation costs up to $30, and $10.50 assistance with monthly service. Aged and Disabled (AABD)- aged means you are 65 or older, disabled means you have a physical or mental impairment that will last at least one year or result in death. Blindness is a type of physical impairment. Available benefits for the aged and disabled are cash and medical assistance including: Medicaid, nursing home costs, home and community based services (HCBS) which enables a person to live at home, and Medicare costs. Child Support: You do not have to be on cash assistance to got help in collecting child support or to receive other child support services. Child Support services include: Establishing paternity, Locating absent parents, Establishing court orders, Collecting child support, and Reviews for modification of child support amounts. Child Support Service is not able to address or resolve custody or visitation issues. REFERRAL PROCESS: To Apply: Local offices of Health and Welfare take applications for assistance program and child support services. If you apply for medical or financial assistance, you will work with a Self Reliance Specialist to find out what help is available. You may request an application in person or by phone, but your application must be in writing. A friend or relative may help you apply. Parents may apply for children. If you do not speak English, you may ask for a translator. If you have questions about who is eligible, ask for more information at your local Health and Welfare eligibility office. ELIGIBILITY REQUIREMENTS: Benefits: All programs have income and resource limits. In addition, there are certain requirements to cooperate with work programs and child support services, depending upon circumstances. To get more detailed information, please speak with your case worker. Child Support: Services are free to anyone receiving Cash Assistance, Food Stamps, and Medicaid, and are available to other families by paying the $25.00 service fee. CSS is required to provide information about all cases to a Federal Case Registry and to other agencies (such as other states’ child support agencies). Your address will not be provided to the other parent without your permission or a special court order. NOTE: Some benefits and child support payments may be accessed by the use of a Quest Card. 13 Map of Districts 14 What is the 2-1-1 Idaho CareLine? The 2-1-1 Idaho CareLine is a toll-free, statewide bi-lingual service available to link Idahoans with health or human service providers and programs. The hours of operation are 8:00 a.m. to 6 p.m. MST, Monday through Friday. After hours and on weekends telephone lines are answered by voice mail. Services Provided. The 2-1-1 Idaho CareLine uses an extensive database of more than 3,000 health and human service providers to support the information and referral activities. The Idaho CareLine links people to services such as prenatal care, immunizations, adolescent pregnancy prevention, Medicaid resources, child development information, adoption/foster care services, nutrition information, child care referrals, child abuse prevention, services for the elderly, diabetes treatment and prevention, and more. The 2-1-1 Idaho CareLine has served as the “central directory” for numerous Department of Health and Welfare programs since 1991. Over the years, the Idaho CareLine has continued to expand and improve, changing with the times and with the needs of the Department. 2-1-1 Implementation. The Idaho CareLine and United Way of Treasure Valley have partnered to implement 2-1-1 services in Idaho. A national initiative, 2-1-1 is an easy access number to health and human services. Idaho is one of 29 states who have implemented this service to date. The Idaho CareLine is the call center for 2-1-1 services in Idaho. The “2-1-1” service became available statewide on all land lines in July 2003, making Idaho the 4th state in the nation to have statewide availability. Six wireless service providers have also implemented the 2•1•1 service for their customers [AT&T, Edge, Cricket, Nextel, Inland and Sprint PCS (most areas)]. More information on the national initiative is available at www.211.org. The Volunteer Center. The United Way of Treasure Valley Volunteer Center is the “Give Help” component of 2-1-1 in Idaho. The Volunteer Center is a centralized clearinghouse that makes volunteering easy and accessible to individuals, families, groups and corporations. The Volunteer Center includes a web based tool that allows individuals wishing to volunteer easy access to agencies needing volunteers or to make donations.
